Phelps seals another London berth

OMAHA -- Michael Phelps booked himself into another event at the London Olympics when he won the 200 meters butterfly final at the U.S. swimming trials on Thursday.

The greatest Olympian of all time remained on course to emulate his incredible eight-gold haul from Beijing four years ago with another powerful display in America's midwest.

Showing no sign of fatigue or weariness despite his gruelling schedule, the 26-year-old powered away from his rivals over the final two laps to win in one minute 53.65 seconds, more than two seconds outside his world record but still the fastest time in the world this year.

"It's not a good enough time to win a gold medal, but I think I'm okay with it," said Phelps.

"Today was the best my stroke has felt throughout the whole meet. So, in all I'm pleased, but I think I need to go faster if I want to win that at the Olympics."

Phelps's Baltimore club team mate Allison Schmitt, who is rapidly emerging as a star in her own right, clinched her second individual swim in the English capital when she won the women's 200m freestyle final ahead of teenage sensation Missy Franklin.

Schmitt followed up her impressive victory in the 400m freestyle on Monday when she led all the way to win the 200m in 1:54.40, the quickest time recorded since synthetic bodysuits were banned at the end of 2009.

Franklin, who won the 100m backstroke final on Wednesday, finished second in 1:56.79 to seal her second individual swim and her third overall with the top six finishers all securing places in the 4x200m freestyle relay.

Caitlin Leverenz won the women's 200m individual medley to earn her second swim in London after finishing runner-up in the 400m medley. Ariana Kukors, the world record holder, flashed home over the last length to grab second spot.

Phelps has now qualified for London in five events and barring any slip-ups, he will swim the exact eight-event program he contested at each of the last two Olympics, winning six golds and two bronze medals in Athens then eight golds in Beijing.

But of all his events, the 200m butterfly is his favorite and the one he has dominated the most. It was the only event he qualified for at the 2000 Sydney Olympics when he was just 15 and it was the event where he set his first world record and won his first world title.

He won the event at five world championships, has held the world record for more than a decade and won the gold medal at the past two Olympics.

"This is my fourth Olympics Games in this event, so it's special to me, special to my family, special to my mom," Phelps said.

"I have a couple of weeks to perfect some things that I'm going to need if I want to end with a good one."

Tyler Clary, who had finished third behind Phelps and Ryan Lochte in the 400m medley, qualified for his first Olympics when he finished second.

Lochte qualified equal fifth fastest in the semi-finals of the 100m freestyle but later withdrew from the final because he is already swimming the 200m medley and 200m backstroke semis on Friday night.

Lochte could still swim in the 4x100m freestyle relay in London if his time in the semis is not bettered by at least five other swimmers.

"We made a plan going into this meet that I was just going to do semi-finals of 100m free and whatever happens, happens," he said.

Lochte's withdrawal provided a lifeline for Jason Lezak to swim the final. The 36-year-old, whose stunning anchor leg swim in Beijing set the platform for Phelps's record eighth gold medal, was a reserve for the final after qualifying ninth overall.

Hawaii food truck owner adds wedding cakes to Fairycakes

The owner of the popular Hawaii food trucks Xtreme Tacos and Fairycakes is getting into the wedding cake business.

Wendy Awai-Dakroub, who also owns a restaurant chain in the Middle East, has purchased Frosted, an established business specializing in custom wedding cakes and cupcakes, from Melissa Char, who sold the business to pursue a master?s degree in education.

Awai-Dakroub is best known in Hawaii for her colorful food trucks that draw long lines at locations around Oahu.

The mustard-yellow Xtreme Tacos truck, which is often seen in Kakaako and around Windward Oahu, sells Mexican food with spicy sauces.

It is accompanied by Fairycakes, a bright purple van named ?Lola,? which serves up whoopie pies, brownies, cupcakes, and gooey bars made from scratch.

Fairycakes? sales took off, and Awai-Dakroub became flooded with requests for wedding and specialty cakes.

?I couldn?t meet these people?s demands with my van, and thought why not,? Awai-Dakroub said. ?So we had our consultants put out a notice that we were looking to buy a wedding company, and, well, here we are.?

Awai-Dakroub intends to keep the Frosted brand, but will call her new business Frosted by Fairycakes. She is looking to hire five people.

Awai-Dakroub is no stranger to the food industry. Twenty years ago, she and her husband, Yossef, opened Sumo Sushi & Bento, now a chain of seven full-service restaurants, in Dubai and Bahrain. She and her husband plan to open their first U.S. restaurant in September, in Seattle.

?Rent in Hawaii was too expensive to open up a full-service restaurant but food trucks were low risk for us,? said Awai-Dakroub. ?But we?d like to open a full-service restaurant because that?s what we?re good at.?

Created in 1967, the award recognizes brilliant accomplishment that does honour to Canada ? arguably the finest example on the latest list being Yannick N?zet-S?guin, the world-acclaimed conductor from Montreal, who at 38 becomes the youngest living Canadian accorded the highest honour, Companion of the Order. (The youngest ever was Terry Fox, at 22.)

The same high honour is given to Ian Binnie, the former Supreme Court member who retired, after a highly regarded 13 years of jurisprudence, from the bench in 2011, as well as Natalie Zemon Davis, a social historian at the University of Toronto who won the prestigious Holberg Prize in 2010.

Recognition is also given to the generosity of philanthropists, such as Winnipeg businessman John Buhler who, having achieved their own personal success, then give back ? to hospitals, parks and art endeavours. And tireless community workers such as Carolyn Acker, in Toronto, who started Pathways to Education to help youth living in poverty.

Among the environmentalists recognized is Laure Weridel, 38, a prominent social activist and writer credited with starting the fair trade movement in Quebec. The daughter of farmers, a background she credits with giving her an awareness of environmental issues, she is also a supporter of Quebec Solidaire, a sovereigntist party with a strong environmental platform. Now completing her doctorate in Switzerland, she wrote in an article for the Alternatives Journal last fall: ?We need a different mindset, a different way to envision what happiness is and what it means to be wealthy and to progress. The status quo is no longer possible.?

The Order of Canada also pays overdue recognition to writers and scientists, long labouring in obscurity outside their own professional circles. One example of the latter is Paul Hoffman, a geologist from Victoria, who is credited with proving the ?snowball earth? theory, which means, in lay terms, what it says: The earth, more than 650-million years ago, was one giant snowball of ice. (Dr. Hoffman is also part of one of the order?s rare sibling combos; sister Abigail, an Olympic athlete and the founder of a hostel for abused women in Toronto, was invested in 1982.)

But the heart of the award springs from its motto: Desiderantes meliorem patriam ? ?they desire a better country.? Or, as 2012 recipient Alia Hogben, executive director of the Canadian Council for Muslim Women, asks: ?What are we all here for, if we don?t do something about it??

Retailers Are `Dismayed' By SCOTUS Ruling - Business Insider

Retailers are "dismayed" by the Supreme Court's decision to uphold most of Obama's healthcare plan, according to the National Retail Federation.

The law unfairly penalizes employers and the private sector, NRF President Matthew Shay said in a?release today.

The Wall Street Journal reported back in 2010 that most retailers said they'd have a hard time complying with employer requirements for the bill. Many retail employees don't currently receive healthcare from their employer.?

The NRF has lobbied lawmakers to make amendments to the Affordable Care Act.?

According to Shay:

??NRF worked closely with lawmakers throughout the debate with the hopes that bipartisan reform would help make coverage more accessible and affordable. The law that emerged in 2010 was a controversial and partisan measure riddled with punitive mandates and penalties that were as unreasonable as they were unworkable.

??Although the Court upheld the law?s constitutionality, many problems remain: it penalizes employers too much; it doesn?t do enough to reduce the cost of health care; and it is unreasonably complicated and difficult to implement and administer.

??This law will have a dramatic, negative impact on every employer and employee in the United States and further constrain job creation and economic growth.

??NRF will redouble our efforts to repeal the law while we continue to work, in good faith, with regulators to smooth implementation for retailers and businesses alike.?

Retailers have been in an intense battle over the law since it first came up. Politico described the potential striking down of the individual mandate?(and upholding of the law's other provisions) a "doomsday scenario" for retailers a couple days ago.

There's a huge intersection between health care and retail, and right now it's going through a time of flux. Aside from the internal issues with employees, retailers like Walmart, Walgreens and CVS have their own consumer-side health care businesses, and are particularly exposed.

For retail workers, most large employers aren't expected to drop health insurance coverage, according to Louise Radnofsky at the Wall Street Journal. They've been preparing for it, and will now have to kick their plans into gear.

Adoption of advanced techniques could propel crop improvement

ScienceDaily (June 28, 2012) ? Scientists could take greater strides toward crop improvement if there were wider adoption of advanced techniques used to understand the mechanisms that allow plants to adapt to their environments, current and former Purdue University researchers say.

In a perspective for the journal Science, Brian Dilkes, a Purdue assistant professor of genetics, and Ivan Baxter, a research computational biologist for the U.S. Department of Agriculture's Agricultural Research Service, argue that today's technology could allow scientists to match physiological and genetic characteristics of plants with the soil characteristics that promote or inhibit their growth. Making those connections could reduce the time necessary to improve plants that are coping with changing environmental and climatic conditions.

"Evolution has solved the problems that we face in terms of adapting plants to grow in a multitude of environments," Dilkes said. "If we understand these processes, we'll be able to apply that knowledge to maintaining diversity in natural systems and improving and maintaining crop yield."

The majority of a plant's makeup, besides carbon dioxide, comes from elements and minerals absorbed from the soil as the plant grows. The physiological and genetic mechanisms that allow plants to obtain iron from the soil, for instance, can also cause the plant to accumulate other elements. Understanding how those changes interact is an important piece of improving plants, Baxter said.

"This is just a hint of the complexity that's out there," said Baxter, a former post-doctoral researcher at Purdue who works for the USDA at the Donald Danforth Plant Science Center in St. Louis. "If we're going to make the necessary improvements in agricultural productivity, we will have to move forward with these techniques."

Much of the work done to understand how plants have adapted to their environments focuses on one gene and one element it controls at a time. Pinpointing one or more genes responsible for a particular trait can take years, even decades.

Dilkes and Baxter believe a wider adoption of molecular phenotyping techniques, such as ionomics and genome-wide association mapping, could allow scientists to work with multiple elements and genes at once.

"By focusing on one gene or one element at a time, you miss out on the other physiological mechanisms occurring in the plant," Dilkes said. "The potential to broaden our understanding of these complex interactions and have a dramatic effect on agriculture is there."

Genome-wide association mapping allows scientists to find genetic associations among multiple phenotypes, or physical traits. The process quickly shows which genes may be responsible for the physical characteristics.

Ionomics studies the elemental composition of plants and how those compositions change in response to environmental or genetic changes.

"Experiments with thousands of samples are now possible," Baxter said. "We've just started to put these things together."

Research in Baxter's lab is supported by the National Science Foundation, the U.S. Department of Energy and the U.S. Department of Agriculture's Agricultural Research Service.

Supreme Court Year in Review

This isn?t just liberal weepiness. I agree that the brain science evidence is squishy, and that arguments about diminished moral reasoning, susceptibility to influence, and impulse control also map readily onto defendants who are older than 18. It all looks like a smoke bomb to deflect from what the justices are really trying to do: Draw a moral line around childhood for sentencing purposes. But one striking thing about Miller and Jackson is the extent to which they were completely trapped by the horrible circumstances of their own lives.? They went, in effect, from one life sentence to another. This argument may also be unmoored from logic, but it?s at least candid, and I found it quite persuasive.

Google simulates the human brain with 1000 machines, 16000 cores and a love of cats

Don't tell Google, but its latest X lab project is something performed by the great internet public every day. For free. Mountain view's secret lab stitched together 1,000 computers totaling 16,000 cores to form a neural network with over 1 billion connections, and sent it to YouTube looking for cats. Unlike the popular human time-sink, this was all in the name of science: specifically, simulating the human brain. The neural machine was presented with 10 million images taken from random videos, and went about teaching itself what our feline friends look like. Unlike similar experiments, where some manual guidance and supervision is involved, Google's pseudo-brain was given no such assistance.

It wasn't just about cats, of course -- the broader aim was to see whether computers can learn face detection without labeled images. After studying the large set of image-data, the cluster revealed that indeed it could, in addition to being able to develop concepts for human body parts and -- of course -- cats. Overall, there was 15.8 percent accuracy in recognizing 20,000 object categories, which the researchers claim is a 70 percent jump over previous studies. Full details of the hows and whys will be presented at a forthcoming conference in Edinburgh.

Jordan Mintzer of Hollywood Reporter in a fresh review: "The Amazing Spider-Man reboots the top grossing Marvel franchise to altogether satisfying results."

Sounds like so far, so good. Competent and satisfying, if not yet a consensus reached that it's totally thrilling. For reference, the original Spider-Man was Certified Fresh at 89%, Spider-Man 2 was also Certified Fresh at 93%, and Spider-Man 3 was merely fresh at 63%.

The Amazing Spider-Man is out in theaters July 3rd. Keep an eye on Rotten Tomatoes for the latest reviews, news, pictures, and trailers as the date approaches.

how do I back up my MBP to my Windows 7?

I use Carbon Copy Cloner with exHDD for my MBP. It's annoying to have it attached. Is it possible to attach that exHDD to my Windows 7 machine and redirect CCC to back it up on the exHDD via Windows 7? I can already access files on my Windows 7 from MBP and vice versa.

My router doesn't have a USB port. And Windows 7 doesn't show my exHDD when I plug it in. Is it because it's Mac OS X Extended (Journaled) format? I went to Computer > Devices and it's working fine but just doesn't show in My Computer.

A computer-software program more effectively controlled blood-sugar levels among critically ill patients than nurse-directed care did, according to the first large clinical trial of its kind. The results will be presented at The Endocrine Society's 94th Annual Meeting in Houston.

The computer program, known as LOGIC-Insulin, was designed to assist healthcare providers in closely controlling patients' blood sugar, or glucose, with the hormone insulin. While insulin treatment is effective, it can be extremely difficult to determine the correct dosage. Excessive amounts of the hormone can cause blood sugar to drop to dangerously low levels, which can cause a serious condition called hypoglycemia. If left untreated, hypoglycemia can result in loss of consciousness, and even death.

Although high blood sugar typically is associated with diabetes, it is also a common complication among the critically ill. When it occurs among these patients, who usually have normal levels, it is called the "diabetes of injury."

In this study, both groups of patients had similar average blood-sugar levels, but those in the LOGIC-Insulin group scored better on specific measures. For example, patients in this group were less likely to develop the critically low levels that are associated with hypoglycemia. They also spent more time in the study's targeted level of 80-110 mg/dL, and exhibited a smaller difference between minimum and maximum blood-sugar readings on a daily basis, indicating less blood-glucose variability.

"Computer-directed algorithms, such as LOGIC-Insulin, that are approved by experts and clinically validated in large studies, will allow safe and effective blood-glucose control," said study director Dieter Mesotten, M.D., Ph.D., assistant professor at KU Leuven (Catholic University Leuven) in Belgium. "This is essential to improve the outcome of critically ill patients in general practice."

Mesotten and his co-investigators randomly assigned 300 critically ill patients to one of two therapy groups. One group received blood-sugar control determined by a team of expert nurses, while the other received treatment based on the LOGIC-Insulin computer program.

The average length of treatment in the single-center study was three days. The study was single-blinded, which means that patients did not know which intervention they were receiving. The primary outcome measure was blood-sugar control up to 14 days after study enrollment.

Patients' average age was 63, one-fifth had diabetes, and 60 percent were male. All patients had been admitted to the intensive care unit, either after undergoing heart or other surgery, or due to other serious medical complications.

According to Mesotten, the study results demonstrate the value of computer-assisted technology in controlling injury-related diabetes.

"The LOGIC-1 study is the first large, randomized, controlled clinical trial that has shown an improved blood-glucose control in comparison with expert nurses, " Mesotten said. "LOGIC-Insulin software improves the efficacy and safety of blood-glucose control in a wide variety of critically ill patients, which may improve their outcome."

Help your coworker build self-esteem by giving her positive feedback.

By sharing your positive attitude, you?re projecting positive energy. When others feel your energy, they?ll tend to respond in a positive way, allowing you to harmonize at the same frequency. Your positive attitude can make a difference!

Sligo Animal Rescue/Donkey Sanctuary Jumble Sale

So yesterday was the big day for the Sligo Animal Rescue and Sathya Sai Donkey Sanctuary jumble sale. Nothing in life goes to plan though and we had a couple of problems. The first one was that I had a warehouse full of jumble in Collooney (thanks to Mick in Signs Express for letting us use his place) and no one to help me transport it to Sligo. Thankfully due to the internet and two of the nicest ladies you could wish to meet Sinead and Vanessa came to my rescue with their vans (who needs men anyway!) ;)

So on Friday we loaded it all up and headed off to Sligo where Steve and Diane had been setting up the hall. As I walked in Steve told me we weren?t allowed to hold the raffle because the hall was a Methodist Hall and it?s considered gambling. I suppose this was my own fault for not checking it out and I really worried about how this would change things.

We carried on regardless though with our jumble sale and above are just some of our wonderful helpers and organisers. All of whom I met through the internet and most of whom I?d never met before our event. Isn?t it amazing how many special people there are out there willing to help! Anyway before I go all mushy I?ll carry on.

Farmer John and Farmer Lucy (and all their little farmers) from Farmyard in your Schoolyard were kind enough to bring along some rabbits, a chicken and her chicks. So the children got to hold them. One lady was saying it?s the first time her son had ever held a rabbit. It?s a fantastic idea. Farmyard in your Schoolyard will bring their animals out to schools and events to teach the children all about them. The farmers cleaned up any bit of mess and made sure everyone sanitised their hands after touching the animals. It really bought people in to the hall as well so a big thank you to them.

During the day people were still bringing in jumble for us to sell. Also wonderful home baking. Again all these people had seen our appeal on the Internet and were so kind to help out. Chapters Coffee House in Sligo were so kind to make us some goodies (and to drive me back to the hall in the pouring rain).

The lovely Niamh arrived with the most amazing cakes. Aren?t they just fantastic. I?m only sorry I didn?t have my camera with me because the phone pics don?t do them justice.

I didn?t get to try a cake as they very quickly sold out but I was told by a little boy that they tasted as nice as they looked (he even said sorry to the donkey before he ate it).

We then had our very own celebrity visitor! This is Dermot Healy, he?s a novelist, playwright and poet. We were delighted to see him, he?s a lovely man :)

Elaine arrived to do face painting for the children. She was brilliant, some really amazing faces going around the place :)

It was a wonderful day, with a great buzz around the place. Lovely to see so many smiling faces and the best news of all is that we raised ?1594!! This will be split equally between Sligo Animal Rescue and the Sathya Sai Sanctuary. The raffle is yet to come so please keep an eye on our Facebook page for updates. Thank you to everyone who helped, we couldn?t have done it without you.

An Exclusive Interview with Mark Waterhouse, Dining Services New ...

If you are one of the few that haven?t heard yet, Mark Waterhouse, owner of the fine dining restaurant Casa Adria, is the new Executive Chef in charge of the Dining Services at AUBG. It seems to us, the Daily staff, that the guy will be around for some time. He has already established some presence by making a group on Facebook (link at the bottom of the article) where he actively communicates with the student body and carefully notes all comments and feedback. The following interview sheds some light on the upcoming changes under his ?rule?.

?
Tell us more about what you did before coming to Bulgaria and what made you come here? Why Blagoevgrad?

I have lived outside the UK for 22 years and before coming to Blagoevgrad spent 20 years in Portugal, working for 4/5 star hotel groups in the marketing departments. My background is in hotels and catering and I have a diploma in hotel and catering management.
Whilst in Portugal I met my wife who is from Blagoevgrad, and when the financial crash hit, we decided it would be a good time to move closer to her family, as we also have two children, Georgia 9 and Cydney 7 and we thought they should understand some of their heritage, culture and learn Bulgarian better.

How were you recruited as the new Executive Chef of AUBG?s Dining Services? Was there a lot of competition for this position?

I don?t know about competition, as the position came about in a funny way. The Provost was having dinner in my restaurant one evening and asked my advice on recruiting a new executive chef for AUBG, and did I have any contacts within the Bulgarian Hotel and catering trade. I said ?no? and thought little more of it, until a conversation with my wife about it, and she said ?why don?t you do it? on reflection I thought ?yes, good idea?, so I approached Provost Reed and suggested it. He put it to the board, I was asked for an outline plan, which I did, and was offered the position last week.

Is Olga Draganova keeping her job as a Manager of the Dining Services and if yes, how do you imagine your work with her?

Of course Olga will keep her job, my Bulgarian speaking is limited and she has a wealth of experience as manager, I see us working together to bring a new outlook to the dining services and Olga will be a big part in putting that to the rest of the staff and seeing it through to its conclusion.

What will happen to the old canteen?

The old canteen will run till the new restaurant (I do not want it called a canteen as it will be far superior to a canteen) opens in the spring, I presume it has been earmarked already for offices or classrooms and is not needed. What is needed is a coffee/snack bar style eatery, with ?grab and go? style food and drink, somewhere the students and faculty can grab a bite to eat and drink.

What dishes do you imagine are going to be offered?

Usual canteen food at AUBG.

That is a big question!!!!! I will bring an international style of food into dining services, fresh, wholesome, nutritional, seasonal and with an eye to our multicultural student body. So fresh soups every day, salad bar, deli bar, sandwiches, wraps, pizza, burgers, several main courses and a selection of desserts. Taking into account ethnic, vegetarian, vegan, allergy and religious tastes.

How about alcohol? Do you think that?s even possible?

Alcohol is an essential part to any restaurant and I feel an essential part for many people to their best eating experience, so to that end I will be looking into adding it to the menu. I can see no reason for it not to be added and with it not being there, it only pushes the student to eat elsewhere, which is what we are trying to change. So my answer to the question is WATCH THIS SPACE!!!!

Any surveys that your planning to conduct? Or are you relying only on social media for feedback?

I am a great believer in using social media, I think the students will reply to a Facebook survey before they will reply to one sent to their AUBG emails. But I will use all media to get in contact with my old and future clients, so I will bombard you with Facebook, Twitter, e mail, TV, web page, word of mouth, and funnily enough good old fashioned talking face to face!!! (I will be asking the journalism dept to help, and other departments I.E. we will need a web page building)

Is there going to be a change in the prices of dishes?

I have purposefully not looked at the pricing policy and how they price the food as I will be pricing as per any outlet that is a business. I have to take into account, food costs, staffing costs, utility charges and many more other costs to come to a figure that is good for the governing body and also good for the students. I will also be pricing to give a wide range of different products at different levels. I can sell a potato salad at a very low cost, but in the same level I cannot sell a rocket salad so cheap. This is where seasonality and best buying of produce will come into its own. I aim to give good value for a good price. But it will be better quality and cheaper than the surrounding eateries.

Do you think that making the Dining Services popular might pose a threat to your business?

I have been asked this question several times in the last week, and my simple answer is NO, it will actually enhance it. The two things are in totally different spheres and as the restaurant only opens late afternoon and does most of its business in the evening, I don?t believe there will be a clash. The restaurant is fine dining, top of the Blagoevgrad tree, we offer what you can?t get elsewhere on a small scale, so I think if the students like what they see in the dining services, they will want to come and taste the foods in the restaurant. We are not an everyday restaurant more of a special occasion, or once a week restaurant. The restaurants in dining services will be a place, I hope, the students and faculty use on a daily basis to eat, drink, socialize at. In fact I want to make dining services the hub of the university where you can come for a coke and a chat or come and get a great three course meal.

Jamie Oliver And School Nutrition: Chef Has 'Lost Faith' In UK Government

British celebrity chef Jamie Oliver has "lost faith" in the UK government when it comes to improving nutrition in schools.

The revelation comes amid Oliver's efforts to extend nutrition to Academy schools, which in the UK are schools directly funded by the central government. Oliver has previously been successful in encouraging other UK schools to adopt healthier school lunch programs.

Oliver's main frustration has been Education Secretary Michael Gove, who the TV star believes is working to erode progress. The Independent has the details:

"I've lost faith in Government, I'll pay my taxes, but I don't particularly expect to see anything," he said in an interview with the Press Association.

"Michael Gove is a nice enough chap and he's got great energy, but it took me a couple of meetings to realise there's no point in going back again.

"He was just charming me and telling me that he is eroding everything that the public demanded and asked for."

Gove has repeatedly stressed his dedication to improving the quality of school meals, but in April Oliver denounced Gove's belief that academies should be able to determine what food to offer, unlike state-controlled schools, which face strict rules. Oliver believes the allowance is a loophole.

Judge tosses out 3 more counts against Sandusky

The judge in the trial of? Jerry Sandusky threw out three more of the child sexual abuse charges Thursday against the former Penn State University assistant football coach?as jurors prepared to begin their deliberations.

Defense attorneys were delivering their closing argument after Judge John Cleland gave the jurors their final instructions in Centre County court in Bellefonte, Pa. After closing arguments from the prosecution, deliberations could begin as early as Thursday afternoon.

Two grand jury reports originally returned 52 counts accusing Sandusky, 68, the former longtime defensive coordinator for the Penn State University football team, of having used his connection to one of the nation's premier college football programs to "groom" 10 boys, whom he met through his Second Mile charity for troubled children, for sexual relationships.


Cleland had already thrown out one of the counts, and Thursday, he dismissed three more.

Two were charges alleging involuntary deviate sexual intercourse with one of the 10 alleged victims, which Cleland said the evidence didn't support. Had the jury convicted Sandusky on those two counts, Cleland said, he would have been required to set the convictions aside.

The third count was a duplicate of another count, he ruled.

Sandusky made no comment as he arrived at court Thursday morning with his wife, Dottie, who testified Tuesday?that she never heard or saw her husband engage in any inappropriate behavior with children during their 45 years of marriage.

Sandusky had been widely expected to?testify?Wednesday before his lawyers abruptly rested their case after a lengthy conference in the judge's chambers.

A source close to Sandusky said "there was no one factor that led to the decision," but?NBC News reported Thursday?that?Sandusky decided not to testify after his lawyers were warned that prosecutors would call his adopted son, Matt, as a rebuttal witness if he did so. The sources, speaking on condition of anonymity, told NBC News that Matt Sandusky was prepared to deliver damaging testimony about his father.

In his final instructions, Cleland told jurors that they had great leeway in determining whether Sandusky's alleged behavior, while possibly troubling, may not have been criminal. ?

"It is certainly a crime for a man to have oral sex with a boy," he said, but "... other forms of physical contact are more problematic."

For example, he said, "It's not necessarily a crime for a man to take a shower with a boy. It's not necessarily a crime for a man to wash a boy's hair or lather his back or shoulders or to engage in back rubbing."

The bottom line was Sandusky's intent, "not the child's reaction," he told the jurors, who heard eight of the 10 alleged victims testify that they were traumatized by Sandusky's alleged advances.

"Any behavior motivated by sexual behavior was a crime," but if Sandusky "did not act out of sexual desire, then he did not commit a crime, even if he did exercise bad judgment."

In other words, "You must distinguish a display of innocent affection from lust," Cleland instructed.

The trial, which opened two weeks ago, is the culmination of an investigation of Sandusky?that led to the firing of head coach Joe Paterno, a college football legend who won more games than any other major college coach in history. Sandusky, who was at his side for many of those victories, was for many years presumed to be Paterno's heir-apparent.

Paterno died in January, a few weeks after the Penn State Board of Trustees dismissed him for not having done enough to stop Sandusky's alleged abuse.
