As school bells ring, retailers start listening for sleigh bells
(Reuters) - U.S. retailers expect another solid showing this holiday season, as summertime surveys and shipments show that companies are placing big orders even as some remain cautious about the economy.
A report from the National Retail Federation showed that increases are expected in imports during August, September and October, critical months when chains get their merchandise from overseas in time to stock their holiday shelves.
Meanwhile, manufacturers and importers surveyed by Capital Business Credit showed "cautious optimism" for the 2012 holiday season, said Andrew Tananbaum, executive chairman of CBC, a non-bank lender for the retail sector.
Such upbeat takes suggest that retailers expect the upcoming winter holiday season could help them overcome what has been a somewhat muted back-to-school season. Retailers such as Walmart and Gap Inc
Some school-related buying has moved later into the year so the books are not yet closed on back-to-school.
"A lot of customers will wait until school starts, and they don't buy things until they absolutely have to," said Wal-Mart Stores Inc
Any dip in the economy can quickly take a toll on sales. In 2008, with the United States in a recession and rocked by news such as the bankruptcy of Lehman Brothers, holiday sales fell 4.4 percent. They did not rise again until 2010.
TRACKING SHIPMENTS
The November-December holiday season makes up the biggest chunk of U.S. sales all year, followed by back-to-school, and recent projections suggest retailers are stocking up.
"Retailers don't import merchandise unless they believe they can sell it, so import numbers are considered a good leading indicator of future sales," said J. Craig Shearman, NRF's vice president for government affairs public relations.
Year-over-year imports are forecast to rise 6.3 percent in August, 7.3 percent in September and 13.2 percent in October according to the NRF's Global Port Tracker, produced by consulting firm Hackett Associates and released on August 13.
In 2011, year-over-year imports tracked by the report fell 7 percent in August, 0.6 percent in September and 5 percent in October.
For all of 2012, import cargo volume at major U.S. retail container ports should rise 4.8 percent from 2011, according to the report. In 2011, such volume rose just 0.4 percent.
Last year, 27 percent of Capital Business Credit's clients -- importers who sell goods to major retailers such as Wal-Mart and J.C. Penney Co Inc
Still, while 33 percent have seen holiday season orders perk up from 2011, 22 percent have seen such orders decrease.
Last year, U.S. holiday sales rose 4.1 percent, outpacing the NRF's October forecast of 2.8 percent but below the rebound of 5.2 percent seen in 2010.
This year, gas prices may be an added concern. The national average price was nearly $3.72 a gallon for regular on August 17, up from $3.58 a year ago, according to AAA data.
"Everyone is constantly worried about what's happening at the gas pumps," said Peter Whitsett, executive vice president of merchandising and marketing for Meijer, a private chain of nearly 200 stores and nearly 180 gas stations.
In states such as Michigan, where Meijer is based, the pop has been even more pronounced. The average price per gallon in Michigan is $3.95, up from $3.67 a year ago, and in spots across the country consumers are paying $4 a gallon or more.
RETAILERS GETTING READY
While the NRF will not issue its holiday forecast for several weeks, retailers are showing optimism, even though it can be hard to get a solid understanding of how consumers feel before the holiday season.

An extra two days between Thanksgiving and Christmas and Christmas falling on a Tuesday versus a Sunday in 2011 are expected to boost sales in the final stretch.

While the overall news in the economy is not all positive, shoppers are still feeling "better than they did in 2008 and 2009," said Jerry Storch, chief executive of Toys R Us
His chain will carry more exclusive products as well as classics such as Lego and Ninja turtles as it tries to win shoppers from its discount and online rivals, and Storch said he expects this should be "a good toy year."
Still, with some shoppers hesitant to spend, especially with rising gas prices, retailers are planning ways to entice such shoppers and reduce their own holiday-related costs.
Walmart will bring back layaway for the holiday season, letting shoppers pay for items over time, and said that it feels good about its inventory levels heading in the holidays.

Giant Military Force May be Needed to Lock Down Syrian Chemical Arms
The Obama administration and friendly governments are considering a situation in which the United States and other nations would have to send tens of thousands of military personnel into conflict-wracked Syria to seize and guard various WMD facilities, Reuters reported on Thursday (see GSN, Aug. 13).
The closed-door brainstorming sessions involve a scenario in which the government collapses and loyalist military forces guarding the country's chemical and suspected biological weapon installations flee their posts, leaving the unconventional arms at risk for theft by nonstate actors such as Hezbollah, unidentified U.S. and foreign foreign affairs sources told the news agency. That situation presupposes that obliterating airstrikes on the WMD sites are not an option due to worries about the release into the environment of deadly poisons and disease materials.
"There could be second-order effects that could be extremely problematic," an anonymous Obama official said of the aftermath of an airstrike.
Washington at present has no intention of deploying military forces to Syria, the Obama official told Reuters. "There is not a imminent plan to deploy ground forces. This is, in fact, a worse-case scenario."
Two unidentified diplomatic insiders said a foreign force as large as 50,000-60,000 land-deployed troops plus assisting personnel could be required to fully secure all of Syria's unconventional arms materials.?
The diplomats emphasized that such an international force would only be in Syria to protect its weapons of mass destruction, not to intervene in the ongoing 17 month rebellion against Damascus.
It is not yet apparent how such an international armed force would be formed and which countries would supply troops. Several European countries have already signaled they would probably not be involved, the diplomatic insiders said.
The United States, Russia, and other nations have repeatedly stressed to the Bashar Assad regime the importance of protecting its chemical arsenal, which is understood to include hundreds of tons of nerve and blister agents that can be delivered in attacks by missiles, rockets, and aerial munitions.
The chemical warfare materials are understood to be spread out at a number of sites around the country. However, there have been reports in recent weeks of some components being relocated by the Syrian military, purportedly to move them away from scenes of intense fighting between regime soldiers and opposition fighters.
The Obama administration would not provide details of crisis response plans for Syria.
National Security Council spokesman Tommy Vietor said that while the administration continues to conclude Syrian chemical arms are being guarded, "given the escalation of violence in Syria, and the regime's increasing attacks on the Syrian people, we remain very concerned about these weapons."
Damascus in recent weeks issued a statement vowing it would not use chemical or biological weapons in domestic attacks but left open the possibility of WMD strikes on international forces looking to intervene in the conflict.
"In addition to monitoring their stockpiles, we are actively consulting with Syria's neighbors -- and our friends in the international community -- to underscore our common concern about the security of these weapons, and the Syrian government's obligation to secure them," Reuters quoted Vietor as saying (Hosenball/Stewart, Reuters, Aug. 16).

VP candidate Ryan releases two years of tax returns
WASHINGTON (Reuters) - Republican vice presidential candidate Paul Ryan on Friday released his 2010 and 2011 tax returns, backing up his running mate in a fight with Democrats who have called for Mitt Romney to be more transparent about his personal finances.
Ryan and his wife, Janna, paid an effective tax rate of 20 percent last year. They paid $64,764 in total federal tax on adjusted gross income of $323,416 in 2011, when they filed an amended return. Their effective 2010 rate was about 16 percent.
Ryan's release of his most recent two years of tax returns was an attempt to back up Romney's position that giving out two years of tax information was enough.
Romney, who has released his 2010 return and an estimate for 2011, has come under fire for not making public details of his prior income taxes. Earlier this week he said he paid at least a 13 percent tax rate every year for the past 10 years.
In January, Romney released information showing he had paid an effective tax rate of 13.9 percent in 2010, mostly from capital gains on investments. The top tax rate for wages is 35 percent, while capital gains are taxed at a lower rate.
Romney's campaign posted the Ryans' returns on its website. "It's time to focus on the real issues in this campaign - turning around the economy and getting America back to work again," the campaign said.
Romney has drawn criticism from Democrats who say presidential candidates typically release financial information going back many years.
President Barack Obama's re-election campaign said on Friday that if Romney releases five years of tax returns, it would not press the former private equity executive to release more - a proposal quickly rejected by Romney's campaign.
Romney, a former Massachusetts governor, is one of the richest men ever to run for U.S. president. He has an estimated net worth of up to $250 million.
Obama's re-election campaign and its Democratic allies have featured Romney's wealth and refusal to release more tax returns in ads painting him as out of touch with the majority of voters.
Polls show the strategy is working. Independent voters in swing states have a lower opinion of Romney after hearing about his business record and personal finances.

US government launches new immigration program
WASHINGTON (AP) ? Young illegal immigrants are scrambling to get passports and other records in order as the Homeland Security Department starts accepting applications to allow them to avoid deportation and get work permits.
Homeland Security announced the details Tuesday of what documents illegal immigrants would need to prove that they are eligible for the Obama administration's Deferred Action for Childhood Arrivals. The announcement came a day before U.S. Citizenship and Immigration Services was set to begin letting people apply for the program.
Hundreds of thousands of illegal immigrants potentially could benefit from the program, which President Barack Obama announced in June. The program is beginning just months before what promises to be a tight contest for the White House in which the Hispanic vote may play an important role.
Obama has come under fire from Hispanic voters and others who say he hasn't fulfilled a previous campaign promise to overhaul the nation's immigration laws. The policy change could stop deportations for more than 1 million young illegal immigrants who would have qualified for the failed DREAM Act, formally the Development, Relief and Education of Alien Minors Act, which Obama has supported in the past.
Republican lawmakers have accused Obama of circumventing Congress with the new program in an effort to boost his political standing and of favoring illegal immigrants over unemployed U.S. citizens.
Some, including House Judiciary Committee Chairman Lamar Smith, R-Texas, have called the policy backdoor amnesty and said they worry about fraud.
"While potentially millions of illegal immigrants will be permitted to compete with American workers for scarce jobs, there seems to be little if any mechanism in place for vetting fraudulent applications and documentation submitted by illegal immigrants," Smith said Tuesday.
At the Honduran Consulate on Tuesday, a line of people wrapped around the building before it was open for business, and the office was crowded for much of the day.
Evelyn Medina, 23, got in line at about 6:30 a.m., and she wasn't alone. With her passport in hand, Medina was all smiles as she walked out of the building just before 2 p.m., saying "Finally" as she clutched the document.
Medina, a Maryland college student studying social work, said she expected to be ready to apply Wednesday. If she is allowed to stay in the U.S. and work, she hopes eventually to earn a master's degree.
The administration plan is to stop deporting many illegal immigrants who were brought to the U.S. as children. To be eligible, immigrants must prove they arrived in the United States before they turned 16, are 30 or younger, have been living here at least five years and are in school or graduated or served in the military. They also cannot have been convicted of certain crimes or otherwise pose a safety threat.
Under guidelines that the administration announced Tuesday, proof of identity and eligibility could include a passport or birth certificate, school transcripts, medical and financial records and military service records. The DHS said that in some instances, multiple sworn affidavits, signed by a third party under penalty of perjury, also could be used. Anyone found to have committed fraud will be referred to federal immigration agents, the department said.
Alejandro Mayorkas, director of U.S. Citizenship and Immigration Services, said being approved to avoid deportation "does not provide lawful status or a path to citizenship."
The paperwork for the program can be downloaded from the Immigration Services website. Applicants must pay a $465 fee and provide proof of identity and eligibility.
A decision on each application could take several months, and immigrants have been warned not to leave the country while their application is pending. If they are allowed to stay in the United States and want to travel internationally, they will need to apply for permission to come back into the country, a request that would cost $360 more.
Honduran Consulate officials said the number of people applying for passports has more than doubled in the past week, and almost all of them have said they were getting passports to apply to stay in the U.S.
Mayra Rivera, 47, brought her children, ages 18 and 20, to the consulate Tuesday from Philadelphia to help them apply for passports.
"They came here when they were children. So, for them, even though they are from Honduras ... this is their adoptive country and they love it a lot," Rivera said in Spanish. "For them to succeed ... is like winning the Lotto."
Rivera, who came to the U.S. seven years ago from Puerto Cortes, Honduras, is not eligible for the program. Homeland Security Secretary Janet Napolitano had said DHS does not intend to use the program to target parents for deportation.
Advocacy groups across the country are planning events starting this week to help immigrants fill out their applications and get all their paperwork in order.
The Migration Policy Institute and the Pew Hispanic Center estimate that as many as 1.7 million people could be eligible to stay in the U.S. and legally work under the new policy.
DHS officials have said repeatedly they don't have an estimate of how many people may apply. In an internal document outlining the program's implementation, officials estimated 1.04 million people would apply in the first year and about 890,000 would be eligible.
The document, obtained by The Associated Press, estimated that the program could cost between $467.7 million and $585.4 million. The department anticipated collecting about $484.2 million in fees.

It might just be easier to pay for the premium flat service for $11.95 per month and not worry about bandwidth restrictions. That's actually a pretty good deal compared to some of the other services on the market. Unlike HotSpot Shield, OkayFreedom does not display any ads on its free version. It offers more bandwidth than proXPN, making it a more appealing product, pricewise. Bulk pricing also kicks in for annual subscriptions, as opposed to going month-to-month.
Wonky Installation Process
Installation was a little strange, which is never a great way to start a review. The link on the Website dropped a downloader tool, which I had to execute to get the actual installation file. There was nothing on the site to indicate the first file was just a downloader and not the installer.
The installation itself was familiar. Like Private WiFi, OkayFreedom replaces the actual hardware adapter on the machine with a virtual network adapter provided by OpenVPN (TAP-Win32 Provider V9). OkayFreedom also downloads security certificates at the end of the process, and then displays a page with terms and conditions.
The problem is, the page is in German. Google Translate tells me the top line is "You must accept the terms and conditions to be allowed to use OkayFreedom. Read them carefully and click at the end of the page to 'Accept.' Otherwise, you may not use OkayFreedom." I guessed it was the Terms and Conditions page, and that I would have to hit "Accept" to continue, but not many people would have thought to scroll to the bottom of the page to see the button. They could have easily closed the window, and wondered why the software didn't install.
One of the biggest problems with terms and conditions and privacy policies is that people just hit okay without reading. Having a page in a foreign language without even the option to switch to an English-language page just compounds the problem. I hope Steganos changes this part of installation so that users can at least switch to a different language to see the page, or have language-specific installers.
Auto-Connect
The field of VPN services is an increasingly crowded one, but Steganos offers an auto-connect feature that is unusual. OkayFreedom relies on a Chrome extension or a Firefox add-on to detect when a user is accessing a geographically restricted site. At this point, the VPN service automatically sets up a connection with a VPN server in the appropriate region to give users the necessary geographic identity to proceed.
I had the Chrome extension installed, but I was unable to see the software kick in automatically when trying to access the BBC's iPlayer to view the livestreams for the Olympics. I managed to get switchover to view iPlayer to work under Firefox, though, but couldn't replicate on other sites consistently.

An investigation by the Federal Trade Commission has determined that Facebook misled hundreds of paying developers into thinking their apps for the social network were receiving special attention. The findings are unrelated to another FTC investigation of Facebook that concluded Friday.
The "Verified Apps" program ran for about eight months in 2009, billed as a way for app developers to get better placement in the network's app directory while also receiving a more thorough examination for possible security problems. Around?254 apps ended up being "verified," a process that cost $375 for normal developers or $175 for students and nonprofits.
Although the company advertised to developers and users that verified apps would receive a more detailed review and "extra assurances" of security and transparency, the FTC found that Facebook failed to deliver on this promise ("Paragraph 46" refers to Facebook's description of the program):
Contrary to the statements set forth in Paragraph 46, before it awarded the Verified Apps badge, Facebook took no steps to verify either the security of a Verified Application?s website or the security the Application provided for the user information it collected, beyond such steps as it may have taken regarding any other Platform Application.?
In other words, they didn't do anything more than they might for any other app, despite receiving money to do so and telling users they had done so. The accusation was part of a larger collection of Facebook's?"unfair and deceptive" practices assembled by the FTC.
The complaint is just that right now, a formal?complaint, and the extent of damage and (if necessary) reparations will be determined later on. The repercussions from a previous FTC complaint were felt Friday, when a punishment was finalized, forcing Facebook to submit to yearly independent audits of their privacy policies, and forbidding certain settings?changes from occurring without user consent.
